Terms and conditions of the Cronos: The New Dawn – “Fluff & Fear” community competition of the company BLOOBER TEAM S.A. 

§ 1 General provisions 

  1. The Organizer of the Competition (hereinafter referred to as the “Competition”) is Bloober Team S.A. with its registered office in Kraków at Aleja Pokoju 18B, 31-564 Kraków, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the National Court Register under KRS number 0000380757, NIP (tax ID): 6762385817, REGON: 120794317, share capital in the amount of: PLN 193.092,60 PLN fully paid up (hereinafter referred to as the “Organizer” or the “Company”). 

  2. These Terms and conditions are binding for the Organizer and the Participants and govern the terms and conditions of participation in the Competition, as well as the rights and obligations of the Organizer and the Participants (hereinafter referred to as the “Terms and Conditions”). 

  3. The Competition is not open to persons employed in the Company under an employment contract or persons providing services to the Company under any title other than employment contract, including contract of mandate, contract to perform a specific task, contract of cooperation or any other similar contract, as well as members of their immediate families. Members of the immediate family shall be understood as: ascendants, descendants, siblings, spouses, parents and siblings of spouses, persons in an adoption relationship, as well as persons under guardianship or curatorship. 

  4. The Competition is not a promotional lottery or a gambling game within the meaning of Article 2 Paragraph 1 of the Gambling Act of 19 November 2009 and is not subject to the rules contained in the aforementioned Act. 

§ 2 Participants of the Competition 

  1. The Competition is open to a person at least 18 years old on the day of entering the Competition who has full legal capacity (hereinafter referred to as “Participant”), who: 

  2. has read and accepted these Terms and Conditions and all their provisions; 

  3. has an account on the social network where the Competition takes place; 

  4. completes the Competition task referred to in §3 point 2. 

  5. By entering the Competition, the Participant undertakes to obey the provisions of the Terms and Conditions. 

§ 3 Rules of participation in the Competition. 

  1. To participate in the Competition, Participant is required to like and share the Competition post published by the Organizer and create and send a competition entry that uses the graphic elements provided by the Organizer (“Competition Task”) to the Organizer’s e-mail address. Detailed terms and conditions of participation are described below. 

  2. The execution of the Competition Task shall take place as follows: 

    a. on channels X (formerly Twitter), Facebook and Instagram of the Organizer (jointly: “Portals”), there will be a post of the Organizer with the announcement of the Competition (“Post”); the Participant is required to like and share the Post on their own profile on any of the Portals; 

    b. the post will contain a link to the Organizer's community on Discord (“Channel”), where the Terms and Conditions will be made available; the Participant is required to click on that link and join the Channel; 

    c. after reading and accepting the Terms and Conditions, the Participant leaves the Fire interaction (:fire: / :flame:) under the Organizer’s information about the Competition that contains these Term and Conditions (or a link thereto); 

    d. the Participant shall independently create a competition entry (“Competition Entry”) that will use at least one of the three graphic elements provided in the Post (“Graphic Elements”); the Competition Entry must clearly refer to the theme of the game: Cronos: The New Dawn and the survival horror genre, and meet the other conditions described in the Terms and Conditions; the Competition Entry must not be created using AI tools; 

    e. the Participant shall send the Competition Entry via e-mail, to the following e-mail address: community@blooberteam.com, with the following subject title: “Fluff & Fear Contest”.  

  3. The Competition begins on March 6, 2026, 17:00 CET and ends on March 17, 2026, 5:00 p.m. CET (the “Competition Period”), with Competition Entries being sent until March 13, 2026, 5:00 p.m. CET. After this time, the Organizer will begin verifying all submitted Competition Entries. 

  4. The Competition will be decided and its results announced on March 17, 2026, 5:00 p.m. CET. Information on this subject will be published on the Portals and Channel. 

  5. The Participant may only enter the Competition individually. This means that a single Competition Entry may only be submitted by a single Participant who is a natural person. 

  6. Participants may submit only one Competition Entry. The same Competition Entry sent by one Participant more than once is counted as one Competition Entry. If a Participant submits more than one Competition Entry, only one of them may be awarded a prize in the Competition. 

  7.  If the same Competition Entry is sent by more than one Participant, only the one sent earliest may be awarded. 

  8. . The Organizer expressly reserves the right to exclude the Participant from the Competition and Competition Task: 

    a. in the event that the Participant receives official notification or become aware of any illegal activity; 

    b. in the event of receiving an official notice or obtaining information, or having reasonable doubt that it contains content that is obscene, offensive to another Participant, vulgar, pornographic or indecent, advertising, offensive to a particular religion or culture, damaging to the image of other persons, the Organizer or other entities associated with them, or in any other way contrary to the principles or norms of social coexistence or to the Terms and Conditions; 

    c. for legitimate safety reasons, insofar as this is required by generally applicable laws; 

    d. in the event of receipt of notice that a Competition Entry does not comply with the conditions set out in the Terms and Conditions; 

    e .in the event of receiving information from the Participant that the Participant had no intention or does not wish to participate in the Competition. 

  9. The Organizer reserves the right to exclude from the Competition Participants whose actions are contrary to the law or the Terms and Conditions, in particular Participants who: 

    a. provide fictitious personal data; 

    b. fail to comply with any of the participation requirements indicated in the Terms and Conditions. 

  10. In the situations referred to in paragraphs 8 and 9, the Organizer will immediately send a notification of exclusion from the Competition and removal of the Competition Entry, together with the relevant justification. 

  11. The social networks X (formerly Twitter), Facebook and Instagram, as well as Discord shall not be held liable for any actions related to the organization of the Competition. 

§ 4 Winners and prizes 

  1. Three Participants shall be entitled to the prize (hereinafter referred to as “Winner”).  

  2. After checking other requirements for the Competition, Winners will be selected by the Organizer based on creativity, originality and spectacularity. 

  3. Each Winner will receive a prize – one gift set, which will include: 

    a. Cronos: The New Dawn Deluxe Edition key for the platform of the Participant’s choice; 

    b. Traveler ND-3576 Plushie; 

    c. “Catfinder” t-shirt; 

    d. Bloober Team mug; 

    e. the book: “Shine On, New Dawn” – The Guide for Young Travelers; 

    f. Cronos: The New Dawn Traveler bottle; 

    g. A surprise item 

    (jointly: the “Prize”). 

  4. Each Winner may receive only one Prize. The Prize cannot be exchanged or replaced, including exchange for cash. 

  5. After announcing the results of the Competition, the Organizer will contact each of the Winners by email. The Organizer undertakes to inform the Winners of the Prize within 7 days of the announcement of the results. The Organizer is not obliged to contact those Participants who did not win the Prize. 

  6. The Winner should contact the Organizer within seven days of receiving the information to provide the data necessary for identification and for issuing the Prize, in particular: 

    a. first and last name, 

    b. full residential address, date of birth, identity number/passport number or if applicable tax identification number, nationality (in order to fulfil the obligation to pay tax on behalf of the Winner). 

  7. The Prize will be delivered in a manner chosen by the Organizer (post/courier). 

  8. In the event of no feedback from the Winner within 14 days of the Organizer’s e-mail about the results to the Winner, the Organizer reserves the right to award the Prize to another Participant according to the Prize allocation rules indicated in the Terms and Conditions.  

  9. The Organizer, acting as the remitter of the lump-sum personal income tax, shall calculate, collect and remit to the competent Tax Office, within the statutory deadline, the lump-sum personal income tax due in respect of the prize, prior to releasing the Prizes to the Winner. 

  10. For this purpose, a cash prize shall be added to the non-cash prizes specified in these Terms and Conditions in an amount corresponding to the lump-sum personal income tax due on the prize in the competition, calculated on the grossed-up value of the combined non-cash and cash prizes (i.e. in the amount equal to 11.11% of the value of the non-cash prizes). 

  11. The Winner acknowledges and agrees that the cash prize will not be paid to the Winner but shall be used by the Organizer to settle the personal income tax due on the prize, which is payable by the Winner. 

  12. The Winner shall provide the Organizer with all information and data necessary for the Organizer to fulfil its obligations as the tax remitter. 

  13. The Organizer may apply the provisions of an applicable double tax treaty (including applying a treaty rate or not withholding Polish tax) only if, prior to the release of the Prize, the Winner provides the Organizer with a valid certificate of tax residence (certificate of residence) and any other documentation reasonably required for the Organizer to apply such treaty. In the absence of such documentation, the Organizer shall withhold and remit the flat-rate tax in Poland. 

  14. The Winner remains solely responsible for any other taxes or reporting obligations that may arise in the Winner’s country of tax residence or elsewhere. 

§ 5 License granted by the Participant 

  1. The participant grants the Organizer a non-exclusive, royalty-free, and global (i.e. without territorial restrictions) license to use the Competition Entry, in particular for marketing purposes, in all known fields of exploitation, including those specified in Article 50 of the Act of February 4, 1994, on copyright and related rights, i.e.: 

    a. in the scope of recording and reproduction of the work - production of copies of the work using a specific technique, including printing, reprography, magnetic recording, and digital techniques; 

    b. in the field of marketing the original or copies on which the work has been fixed - marketing, lending or renting the original or copies; 

    c. in the scope of distribution of the work in a manner other than that specified in point b - public performance, exhibition, display, reproduction, broadcasting and rebroadcasting, as well as making the work publicly available in such a way that everyone can have access to it at a place and time of their choosing. 

  2. The license is granted for a period of 5 years. After this period, it is considered to be granted for an indefinite period with a one-year notice period. 

  3. The Participant declares that they are the sole author of the Competition Entry. 

  4. The participant undertakes not to exercise moral rights to the Competition Entry. 

  5. The Winner shall indemnify the Organizer against any third-party claims arising from the fact that, on the date of granting the license described above, the Winner did not have the rights specified in these Terms and Conditions. 

§ 6 License granted by the Organizer 

  1. The Organizer grants the Participant a non-exclusive, royalty-free license to use the Graphic Elements in the following fields of exploitation: 

    a. in the scope of recording and reproduction of the work - production of copies of the work using a specific technique, including printing, reprography, magnetic recording, and digital techniques solely for the purpose of creating the Competition Entry and within the scope of that Entry;  

    b. in the scope of distributing the work – by sending the Competition Entry to the Organizer. 

  2. The license is granted for a fixed period, which is the same as the period during which the Competition Entries may be sent, i.e., from March 6, 2026, 5:00 p.m. CET, to March 13, 2026, 5:00 p.m. CET.  

  3. The license is granted solely for the purpose of enabling the Participant to participate in the Competition. The Participant must not use the Graphic Elements for any other purpose. 

§ 7 Personal data protection 

  1. The Organizer will process personal data provided by Participants in the following scope: e-mail address, name and surname, address of residence (hereinafter referred to as “Personal Data”). 

  2. The Participants' Personal Data will be processed by the Organizer in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter “GDPR”). 

  3. Participants' personal data will be processed for the following purposes and on the following legal basis: 

    a. to take part in and carry out the Competition, as well as to issue the Prize and to pay tax, to process complaints, on the basis of Article 6(1)(a) and (b) of the GDPR; 

    b. to make settlements, to assert claims relating to the conduct of business, for archival (evidential) purposes to secure information in the event of a legal need to prove facts, which is a legitimate interest on the basis of Article 6(1)(f) GDPR; 

    c. the keeping of accounts on the basis of Article 6(1)(c) GDPR in connection with Article 74(2) of the Accounting Act of 29 September 1994 (Journal of Laws of 2018, item 395); 

  4. The Participants' personal data will be transferred to the Organizer for the purpose of conducting the Competition, issuing the Prize, dealing with complaints and taking other actions provided for in the Regulations and the law. The Participants' personal data may be transferred to other entities in connection with the fulfilment of the purposes indicated, as well as to entities engaged in tax settlement on behalf and for the benefit of the Organizer. Participants' personal data will not be transferred to a third country or to international organizations. 

  5. Participants' personal data will be stored: 

    a. in the case of the processing of data referred to in paragraph 3(a) and (b) of this section, until the expiry of the period of limitation of claims; 

    b. in the case of data processing referred to in paragraph 3 point c) of this point - for the period required by the provisions of the Accounting Act. 

  6. The Participant has the right to request access to his/her personal data, rectification, deletion or restriction of their processing, as well as the right to data portability. The Participant has the right to lodge a complaint with the President of the Office for Personal Data Protection if the processing of his/her personal data violates the provisions of the GDPR. The Participant has the right to withdraw consent to processing, but the exercise of the right to withdraw consent does not affect processing that has taken place up to the point of withdrawal of consent. The Participant's personal data will not be used for automated decision-making with legal effects against the Participant. 

  7. The provision of personal data is voluntary, but necessary to take part in the Competition and receive the Prize. 

§ 8 Complaint procedure 

  1. Each Participant has the right to raise a written complaint regarding the way the Competition was conducted within 7 days of the announcement of results. 

  2. Complaints can be submitted to the email address: biuro@blooberteam.com with the email title “Complaint - Cronos: The New Dawn – “Fluff & Fear” community competition”. 

  3. The complaint must contain the exact details of the complainant (name, surname of the complainant, correspondence address, e-mail address), the reason for the complaint and the demand made by the complainant. 

  4. The complainant will be notified of the outcome of the complaint by registered mail and e-mail within 14 days from the date of receipt of the complaint to the address specified in paragraph (3) above. 

  5. Raising a complaint shall not stop the distribution of the Prize. 

§ 9 Final provisions 

  1. The Organizer reserves the right to make a binding interpretation of the provisions of these Terms and Conditions, settle any disputes arising from their application and any issues relating to the Competition. 

  2. In matters not regulated by these Terms and Conditions generally applicable provisions of Polish law shall apply, in particular the Civil Code and the Act on Copyright and Related Rights.
